By making a reservation through VN Consulting Real Estate, SL, the tenant expressly accepts each and every one of the general conditions that are considered an integral part of the reservation and are supplemented by the specific applicable legislation.
VN Consulting Real Estate, SL manages the properties that appear in the advertisements on its website and has been authorized by the owners of the same to manage and lease these seasonal accommodations under the conditions and with the furniture and services whose description and photographs have been displayed to the tenant on the advertisement page.
BOOKING PROCESS: The accommodation can be booked by the tenant online through our website booking.vnconsulting.es, by phone at +34 972 919 707 or by WhatsApp at +34 670 56 64 22. For online reservations, a request for availability (pre-reservation) will first be sent, which will be confirmed by VN Consulting Real Estate, SL within a maximum period of 24 hours. In the availability confirmation email, you will receive the necessary information to be able to make the payment on account of 25% of the total reservation, not including charges for additional services not included, deposits and tourist tax (if applicable), by bank transfer. By making the payment on account of the reservation, the tenant confirms again that he has read and understood the general conditions of VN Consulting Real Estate, SL and that he accepts them. The tenant will receive an email confirming his reservation for his stay once the payment of the reservation amount has been made. This email must be presented to the VN Consulting staff in charge of delivering the keys.
PRICING POLICY: The published prices of the accommodations are always prices per night and accommodation based on the indicated period and are expressed in Euros. VN Consulting Real Estate, SL will carefully prepare both the descriptions of the accommodations and the published prices, so that they reflect reality at all times. However, these may in some cases undergo some modifications that will be communicated at the time of formalizing the reservation. The prices of the additional services are clearly indicated at the time of booking. Payment transactions will be made in Euros, regardless of the origin of the tenant or the accommodation selected.
PAYMENT ON ACCOUNT: The tenant will pay 25% of the total amount by bank transfer to the bank account of VN Consulting Real Estate, SL, which will be provided at the time of booking.
PAYMENT OF THE REMAINING AMOUNT; The remaining amount 75% plus services, additional charges, deposits and tourist tax (if applicable) must be paid upon arrival, before receiving the keys.
RESERVATION CANCELLATION POLICY: VN Consulting Real Estate, SL reserves the right to cancel the reservation if, after 24 hours from the confirmation of the availability of the reservation, the payment has not been received in the bank account of VN Consulting Real Estate, SL.
In the event that VN Consulting makes changes to the accommodation services and/or published prices after confirmation of the reservation and up to 8 days before the tenant's arrival at the accommodation, which affect essential points, the tenant may unilaterally terminate the contract, free of charge, within 7 days following said communication, and the payment made will be reimbursed. A cancellation is considered to have been made at the moment that VN Consulting Real Estate, SL has received the cancellation in writing.
VN Consulting Real Estate, SL reserves the right to cancel the reservation for reasons of force majeure beyond the control of VN Consulting Real Estate, SL or serious deficiencies in the accommodation that prevent its normal use. These circumstances will be communicated to the tenant as soon as they are known and, to the extent possible, VN Consulting Real Estate, SL will propose an alternative re-accommodation solution with characteristics and price as similar as possible to those contracted by the tenant. If re-accommodation is not possible due to a lack of available accommodation or because the tenant rejects all the re-accommodation proposals offered, the proportional part of the amount will be refunded (according to the time that the accommodation has been enjoyed) without any additional liability being attributed to VN Consulting Real Estate, SL. Without prejudice to the provisions of the applicable regulations, the liability of VN Consulting Real Estate. VN Consulting Real Estate, SL is limited to its role as intermediary, in accordance with the scope of this role and its effective development by VN Consulting Real Estate, SL, not assuming any of the responsibilities that, according to the Law, correspond to the property in the rental of accommodation. In any case, the tenant accepts that the financial responsibility of VN Consulting for any damages that may occur as a consequence of its intermediation, will be limited to the total amount paid by the tenant.
In the event that the tenant unilaterally cancels his/her reservation more than 60 days before the agreed rental start date, the tenant accepts and acknowledges that he/she will be reimbursed 100% of the amount paid, deducting €50+VAT for reservation management fees and also deducting any other expenses incurred by VN Consulting Real Estate, SL (e.g. bank fees, etc.), if applicable. The tenant understands and accepts that such early cancellation, although it allows for a refund, involves work and may entail costs for VN Consulting Real Estate, SL that must be compensated. The deduction of these management fees and other expenses incurred (if any) is considered a reasonable measure to compensate VN Consulting Real Estate, SL for the efforts made.
In the event that the tenant unilaterally cancels his/her reservation less than 60 days prior to his/her arrival date, fails to show up on the agreed rental start date or partially cancels the reservation, the tenant accepts and acknowledges that he/she will lose the total amount paid. The tenant understands and accepts that the reservation of a vacation rental implies the exclusive reservation of the same for the agreed period, resulting in the denial of other rental requests and the possible loss of additional rental opportunities. The tenant understands and accepts that the loss of the total rental amount is a reasonable measure to compensate the owner for losses incurred due to non-show or partial cancellation. In this case the tenant will not be able to claim or demand the reimbursement of amounts already paid.
DEPOSIT: The tenant must provide a deposit in the form of a pre-authorization on his/her valid and active VISA or MASTERCARD credit/debit card. This pre-authorization will be made on the day of the start of the rental and will be maintained throughout the rental period, in order to cover possible damages, losses or non-compliance by the tenant. Said pre-authorization will be in the amount specified in the accommodation advertisement, which will not be charged to the tenant's credit card, but blocked from the available balance. Notwithstanding the foregoing, VN Consulting Real Estate, SL will have the right to retain, in whole or in part, the amount of the pre-authorization to cover the costs of repair or replacement of damages caused, lost items, or as compensation for damages suffered. VN Consulting undertakes to notify the tenant in writing of any total or partial retention of the amount of the pre-authorization within a reasonable period after the end of the rental period. If no damages, losses or non-compliance occur, VN Consulting will release the pre-authorization in full within a maximum period of 5 working days. The tenant acknowledges and accepts that VN Consulting will not be responsible for any delay in the release of the pre-authorization due to circumstances beyond its control, such as banking delays or administrative processes.
In the event that the amounts to be deducted from the deposit exceed the amount of the deposit established in your reservation, the tenant will be responsible for paying any additional amounts necessary to cover such damages. Both parties agree that the deposit established in this contract does not limit the liability of the tenant for damages caused to the vacation accommodation, and that VN Consulting Real Estate, SL may seek additional compensation in the event that the damages exceed the amount of the deposit. In the event that the tenant fails to comply with its obligation to pay the difference for additional damages within a reasonable period of time, VN Consulting Real Estate, SL will have the right to take legal action to recover the amount owed, including legal and collection costs incurred.
